Terms of Use
These terms are intentionally split into two areas: general rules for KALYIX and additional rules for the Tip product area.
KALYIX
This section applies to KALYIX in general. Additional rules for user pages, support payments, overlays, and alerts are in the Tip section.
1. Provider and scope
KALYIX is provided by Lukas Hunger, Gartenstraße 11, 09618 Brand-Erbisdorf, Germany. Contact details are available in the imprint.
KALYIX includes kalyix.de, account features, documentation, project pages, updates, and connected technical services. Individual product areas may run on their own subdomains or services.
2. Development status
KALYIX is under active development. Features may be marked as alpha, beta, preview, demo, or legacy and may change, be limited, or be discontinued.
The old KALYIX V1 build is only a legacy and reference state. The separate build notes also apply.
3. Account, login, and security
Some features require a KALYIX account or login through a third-party provider such as Twitch. Users must protect credentials, sessions, and linked provider accounts carefully.
Accounts must not be misused, attacked automatically, resold, or used to bypass technical protection measures.
4. Prohibited use
- unlawful, fraudulent, misleading, or abusive use
- infringement of copyright, trademarks, personality rights, or other third-party rights
- distribution of malware, phishing, spam, hate speech, calls for violence, or illegal content
- bypassing security, rate-limit, payment, or access protection mechanisms
5. Availability, changes, and termination
There is no claim to uninterrupted availability. Maintenance, errors, security measures, third-party changes, or infrastructure issues may temporarily limit features.
KALYIX may change, extend, restrict, or remove features where this is technically, legally, security-related, or product-related necessary.
Users may stop using KALYIX at any time and delete their account where account deletion is technically offered. Legally required retention remains unaffected.
6. Liability and law
Liability for intent and gross negligence follows statutory law. For simple negligence, liability is limited to breaches of essential contractual duties and to foreseeable typical damage where legally permissible.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection rules provide otherwise.
Tip
This section adds rules for the Tip product area. The general rules are in the KALYIX section.
1. Product area
Tip is a KALYIX product area for user pages, support payments, goals, links, icons, public pages, overlays, and alerts.
Tip can create public URLs, for example for user pages, checkout flows, OBS overlays, or alert output. Anyone sharing or embedding such URLs is responsible for using them in their own setup.
2. User content
Users are responsible for content, links, text, media, goals, overlays, and public pages they create.
Users must make sure their content does not infringe third-party rights and does not contain unlawful, misleading, or abusive content.
3. Support Box and live use
Using Tip currently does not require embedding a Support Box on the public page. Users can therefore also use Tip as a simple homepage, link page, or information page.
If use without a Support Box reaches a level that makes operating Tip and KALYIX economically unsustainable, KALYIX may activate a requirement to embed the Support Box.
If this requirement is activated, publishing or continued live use of a Tip page may depend on a Support Box being embedded and a functional Stripe account being connected.
4. Payments, Stripe, and support amounts
Payments in Tip are technically processed through payment providers such as Stripe. Payment processing, payment data, and Stripe accounts are also subject to the terms and privacy notices of the payment provider.
KALYIX is not the bank, card issuer, or payment provider. Payout capability, fees, reviews, restrictions, and chargebacks may depend on the payment provider.
Users must check for themselves how received support amounts are treated for tax, business, or accounting purposes.
5. Restriction and removal
If there are indications of unlawful, abusive, or security-relevant use, content, public pages, overlays, alerts, links, or accounts may be restricted, disabled, or removed.
In obvious risk, abuse, payment risk, or legal requirement situations, action may also be taken quickly.
